Remittance Terms

Payment should be with order.

For credit card your card is preauthorized only at order time and will be charged when we reserve and pack the order (preorders such as Beaujolais Nouveau excepted). If you choose Paypal it will be charged at the time you place the order.

We also accept payment by BACS bank transfer (Account details will be mailed after the order), cheque (payable to NickDobson Ltd), VISA, Mastercard, and major Debit Cards over the phone.

Age Verification Policy



All customers must be aged 18 years or over; we operate an age verification policy which may involve us making enquires about you to ascertain that you are over 18 years of age and you expressly consent to our accessing legally held information in order to do this.

It is our Policy not to sell alcohol to individuals under the age of 18 years and to have in place an appropriate age verification policy which requires individuals who (where we see them) appear to be under 18 years of age to produce on request, before being supplied with alcohol, identification bearing their photograph, date of birth and a holographic mark. Where we do not have visual contact with a customer, for example when an order is placed by a customer remotely for delivery by mail order, we will form a view as to whether or not the customer is under or over 18 and where we could reasonably suspect that the customer is under the age of 18, we will not supply alcohol to that customer. We will ask the customer to confirm that they are over 18 years of age and we may also use various additional methods to assess the age of the customer, which may include contact with the customer by telephone or other means, or by reference to information about the customer which is either in the public domain or is available through the use of commercial
age verification systems and databases operated by third parties. Such age verification may be without explicit reference back to the customer, although if appropriate we may ask a customer to supply us with vidence of their age.

Where we Sell



We supply throughout the UK. We may be able to supply overseas customers, but regulations regarding the import of alcohol vary from country to country, and we cannot guarantee to service all markets. In addition, the cost of carriage may be very high. Export enquiries are treated on a case-by-case basis.

By placing an order with us, you are making an offer to buy goods and/or services. Where goods or services are supplied by third parties, this will be made clear on the website, and your contract will be with the supplier and not with us. Examples of this include, but are not limited to, bookings for restaurant meals and other wine events. A legally binding contract between us or the supplier comes into force only when we have received your order (however received) and we or the supplier has subsequently accepted it and, in the case of wine sales, despatched the goods. For the avoidance of doubt, the automatically-generated confirmation mail you receive after placing an order is not, and should not be construed as, acceptance of an order. An order may only be accepted when we or the supplier have received and had a chance to review it, and not all orders may be accepted.

The law applicable to and governing the contract between us is UK law.

Minimum order size - as of 1 January 2012 we have a minimum order value of £50. This figure is inclusive of taxes but excludes carriage costs.

Pricing - the price list published on our website shows prices for bottles of size 75cl unless otherwise stated. Prices include duty and VAT at the current rate but exclude carriage. Prices are subject to change without notice in line with currency movements, tax and duty changes, changes in supply and transportation costs or for any other reason. We will normally absorb minor fluctuations in costs, however if a price has changed between an order being placed and our processing it we will contact you.

Purchase procedure - Making a purchase could not be easier. Just browse our Catalog, and click on any items that you wish to buy and put them into the shopping cart. After you have finished your selection, click on "Checkout" and you will be asked for a few details that we need to be able to satisfy the order. Please ensure that you select both a method of payment AND a method of delivery from the dropdown menus provided. The contract between us is made when we have received your order and susequently accepted it. If you prefer not to place your order via the internet, you can do so by telephone. Should you make an error whilst entering the order details, you will have the opportunity to correct the error prior to finalising your order, using the "back" buttons in the checkout screens. The point at which the order is actually placed is clearly identified in the checkout process. On placing your order you will receive an email confirming that we have received your order; this contains all the order details for you to check. Should you find that you have placed an order containing errors, please contact us by telephone as soon as possible, and we will do our best to amend your order. If your goods are despatched prior to your notifying us of any errors in your order, our returns policy applies.

Beaujolais Nouveau

The following additional conditions apply also to pre-orders of Beaujolais Nouveau: In addition to our normal terms and conditions the following supplementary terms and conditions apply to pre-orders of Beaujolais Nouveau and Beaujolais Villages Nouveau 2013 placed before 15 October

  1. We will guarantee availability of wine (force majeure excepted) for firm orders placed by 15 October 2013
  2. Orders placed by 15 October are considered firm orders and payment will be collected at the time of order placement
  3. As we are purchasing specifically for you against pre-order, your order is a bespoke order and as such exempt from Distance selling regulations. This means that you may not cancel an order once placed.
  4. The wines will be despatched with the intention that they arrive on the official release date, and we have typically achieved this every year in the last 5 years. However delivery on that day is not guaranteed and non-arrival on that day will not constitute cause for order cancellation.

Shipping And Handling

Our current delivery tariff can be seen below. We offer a standard basic untimed service. Normally a signature is needed but you can specify an alternative (leave with neighbour etc) if you might not be in. Other delivery options MAY be available on a case-by-case basis - please enquire before you place your order. Orders sent to multiple addresses will be treated as seperate orders for delivery charge purposes.

We do not aim to profit from the delivery charges - as a matter of fact delivery and packaging cost us more than we charge - but we have to reflect the costs we bear in getting your wine to you. Please note all delivery charges are subject to VAT. If we can find a cheaper rate we will refund the difference!

Our delivery charges may seem high but wine is a sensitive product and needs to be transported with care. We take the condition of your wine seriously and as such we use specialist, high quality, extremely safe packaging (it is fully recyclable too!). We select fast delivery options with specialist couriers to minimize the time once out of the warehouse's controlled environment. As a result of this, the courier will not wait more than 3 days or retry delivery more than once (see below) so please use an address where you will be present for your order to be delivered. London deliveries are fulfilled by our warehouse van, and are

Delivery to non-mainland UK addresses other than those listed as delivery options is usually possible, but may not be on a next-working-day basis, and can be quite expensive - please call to enquire for a quotation. For remote locations we can use your selected courier.

Our wines are stored in a warehouse in the east London/Kent area and you may collect your wines here and avoid delivery charges if you wish, but this is only by arrangement and you should discuss with us when you wish to do this. The warehouse also requires time to process orders and prepare your wines for collection.

Delivery to overseas addresses - we can service some but not all markets, please enquire. Please contact us to enquire for a quotation for export terms.

If you specify a neighbour or "leave behind ..." location for the goods, neither we nor the carriers will accept liability if goods are lost, damaged, or stolen subsequent to being left.

Notes:-

1. All carriage costs are subject to VAT
2. With standard UK mainland services, delivery is normally within 7 working days.
3. We no longer routinely offer other premium services (timed deliveries, evening & weekend deliveries) as the costs and reliability of these are unpredictable. However, these MAY be available on a case-by-case basis but will be subject to individual quotation. If you think you may need one of these services, please call for a quote before placing your order.
4. 1 case means up to 12 bottles of any size up to 75cl.
5. Magnums are subject to special handling and are excluded from the above table - please call for more information.

If nobody is at home when an attempt to deliver is made, and you have elected for SIGNED FOR delivery, the driver will leave a card with a telephone number for you to call to arrange for a further delivery attempt. If you have not called to arrange for a new delivery attempt within 3 working days the goods will be normally be returned to us, and costs incurred in returning the goods to us, and any subsequent costs for redelivery of the wine after this time will be at an additional cost to you - we will charge you the actual cost price to us for these services, which may be more than the original delivery cost, which is subsidised. Please ensure accurate instructions are given.

You expressly authorise us to charge to your credit/debit card any costs involved with goods being returned in the event of your not being able to receive them and not making contact with the carrier. Likewise you expressly authorise us to charge to your credit/debit card any difference between the cost of the carriage option you select, and the correct carriage option, where you select the wrong carriage option, e.g. if you specify the wrong geographic region applicable to your order. Please note that the cost differences can be significant - eg the difference between UK mainland and offshore islands - and it is your responsibility to check this.


Delivery Schedule

Delivery by third party carrier, which may be a courier or our warehouse van.

We endeavour to ensure your wines are dispatched within 2 working days (typically 1), for next day delivery. Orders should always arrive within a week.

Please note we cannot provide an absolute guarantee of delivery on a specific date or at a specififc time - this is simply not possible where 3rd parties are involved to provide logistics and delivery services.

If you chose "Invoice me" as an option, the goods will be shipped only after payment has been made - we will try to contact you by email and telephone but if speed of delivery is important, contact us. In the case of payment by cheque, we reserve the right to await cheque clearance prior to despatch of goods.

Deliveries by carrier are not made on Saturdays, Sundays, or Bank Holidays. Additionally there may be occasional office closures due to holidays etc, when the normal delivery schedule will not be possible. If this applies and the order will not be shipped within our normal turnaround times, you will be notified of any delay, and you will have the option to cancel.

Breakages/Damage

wine should be examined on delivery for both condition and completeness/correctness of order. Any problems should be noted on the delivery note, and we should be advised as soon as possible, and at the latest within 48 hours. If it is not possible to inspect the goods on delivery, the carrier's delivery note should be marked "unexamined".

Special Delivery Instructions

If you do not expect to be at home to receive your wine when it is delivered, you may leave special delivery instructions (e.g. "leave in shed", "leave behind side gate"). You should also leave a signed note addressed to the carrier authorising them to leave the goods without a signature. We will pass such instructions to the carriers; however neither we nor the carriers will accept responsibility should for any reason the wines be lost, stolen, or damaged as a result of such instructions being followed. Please think of temperature when specifying a location as wine quality can be affected if left in heat or cold for too long. Our packaging provides some thermal insulation for a limited time but cannot protect against frost or direct sunshine

Please do not specify a specific delivery time or range of times with standard SIGNED/UNSIGNED delivery options, as these are UNTIMED and the carrier is not obliged to follow such a request.

Back Orders

We aim to stock all wines in our list, however all product is offered subject to availability. Some of the wines are made in very small quantities and it may not be possible to obtain replacement stocks quickly or even at all. In the event that a wine is not available in a bespoke selection you have made, we reserve the right to substitute a wine of equal or better quality of very similar style/origin where this affects no more than 3 bottles per case. We also reserve the right to substitute in any quantity a more recent vintage of any wine ordered, and in either of these situations if we do this we will absorb any increase in cost.

Other than for these situations, we will not normally substitute without contacting you first to discuss alternatives and seek your approval. Alternatively you may wish to wait until stocks are available. You will always be contacted with the option to cancel your order if you would rather not wait. For mixed cases where we have pre-defined the composition, we reserve the right to make appropriate substitutions, although these will alway be similar wines from the same region, and of equal or greater quality/value.

Tax Charges

Prices shown on this website include all customs duties and charges and VAT at the current rate, but exclude carriage. In the event of the UK VAT or customs duty rates changing, prices are subject to change.

For overseas shipments within the EU we are obliged to charge you UK VAT unless you are a VAT-registered trader in your country and provide us with your EU VAT number.

For overseas shipments to non-EU countries we can normally supply product on a zero-rated VAT basis, i.e. without charging you VAT.

Note that for overseas orders you are responsible for the payment of any taxes, duties, or other costs of any type including but not limited to customs agents charges levied on import to your country.

Credit Card Security

Online credit card payments are handled by a specialist third party Payment Services Provider, Actinic Payments, who work with Creditcall, one of the world's largest Payment handlers. The service is fully level 1 PCI-DSS compliant - this is the highest security accreditation available. If you pay online, we do not see your card details.

We also offer Paypal as an additional secure option.

If you order by telephone and pay with a card, we process your payment manually using a terminal and we do not record or retain your card details. This means that we will have to ask you to furnish card details for each order.

Guarantee

Wine is a living, breathing thing and it is a well-documented fact that despite the best endeavours of the producers, a tiny proportion of wines may suffer from some defect (eg may become corked).

We offer a guarantee of quality; if any wine we have supplied proves to be defective, we will replace it without question, or provide a refund, if you prefer. Should this occur, please contact us. However, as we are unable to control the environment in which the wine is stored after purchase, this guarantee will only apply for notifications received within a reasonable period from the invoice date. This guarantee applies to defective wines only, and we are normally unable to refund or replace where a wine is simply not to your taste. But if you are disappointed, do contact us, we want you to be delighted with our wines and our service!

Tasting notes are published on our website for many of the wines we sell. People's taste and olfactory capabilities vary, and as such any description of a flavour or smell is subjective. The tasting notes we publish are entirely our own opinion, and should not be relied upon as definitive descriptions of how a wine tastes.

Label/Bottle images are also published for many of the wines in our range. Whilst we endeavour to use up to date accurate images, these are not always available, and in some cases the label image published may not be exactly the same as that actually attached to the bottle.

This site uses cookies to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used, & to store your details if you select the 'Remember Me' Option. They are also as part of the account login/out process. We do not use them to generate advertising.

Returns Policy

We do not supply goods on a sale or return basis unless this has been expressly agreed at the time of purchase. However we aim to comply with the Distance Selling Code of Practice for Wines and Spirits ("the code") published by the Wine and Spirits Trade Association (WSTA). This gives customers the right to cancel any Wine by Mail purchase, except for bespoke shipments, up to seven days after receipt of the goods, conditional on the goods remaining in good condition. Goods should be returned in the same condition in which they were supplied, and with bottles unopened, at the customer's expense. Monies will then be refunded in accordance with the code. This does not apply to export orders.

Where a sale or return agreement has been entered into, goods may be returned and monies will be refunded in accordance with the terms of that individual agreement (trade customers & wedding/event orders).

Where no such agreement was entered into, and where wines have been correctly supplied, unless faulty, and other than as provided for by legislation and/or the code, we will not normally accept these for return/refund. We will consider accepting such returns only in exceptional circumstances. All such returns are subject to the following conditions:- (1) we must have agreed to accept the return (2) the wines must have been stored correctly, and be in good condition (3) return carriage is at the customer's risk and expense (4) we will not accept such returns more than 30 days after the original invoice date (5) there is a restocking charge to cover costs we incur as a result of the return, which will be deducted from any refund.
